BY VIRTUE of a judgment heretofore granted in the case of AllSouth Federal Credit Union vs. Deborah S. Baughman Individually and as Personal Representative of the Estate of Willard Carlisle Berry; Crystal Smith; Carol Ann Garifalon; and all Unknown persons with any right, title or interest in the real estate described herein; also any Unknown persons who may be in the military service of the United States of America, being a class designated as John Doe; and any Unknown minors, persons under a Disability or persons incarcerated, being a class designated as Richard Roe and Lexington County, I, Carol Ann Tolen, as Special Referee for Fairfield County, will sell on April 3, 2017, at 11:00 am, at the Fairfield County Courthouse, 101 S. Congress Street, Winnsboro, SC 29180, to the highest bidder:

All that certain piece, parcel or tract of land, with any improvements thereon, situate, lying and being in the County of Fairfield, State of South Carolina. Same being shown and designated on that certain plat for Willard C. Berry and Judith E. Fetner prepared by Donald G. Platt dated July 15, 1986 and recorded in the Office of the ROD for Fairfield County in Record Book “IV” at Page 77. Reference being craved to said plat for specific metes, bounds and distances. All measurements being a little more or less.

 This being the same property conveyed to Williard Carlisle Berry and Judith E. Fetner by deed of Marion C. Fetner, Jr. dated July 17, 1986 and recorded in the Office of the ROD for Fairfield County in Record Book “IV” at Page 78. Thereafter conveyed to Willard Carlisle Berry and Judith E. Berry by deed of Willard Carlisle Berry and Judith E. Berry f/k/a Judith E. Fetner dated July 7, 1997 and recorded in the Office of the ROD for Fairfield County in Record Book “QQ” at Page 113. Thereafter conveyed to Willard Carlisle Berry by deed of Judith E. Berry f/k/a Judith E. Fetner dated December 21, 2005 and recorded in the Office of the ROD for Fairfield County in Record Book 764 at Page 304 on February 1, 2006.

 SUBJECT TO FAIRFIELD COUNTY TAXES

TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Special Referee at conclusion of the bidding, five (5%) of his bid, in cash or equivalent, as evidence of good faith, the same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to Plaintiff’s debt in the case of noncompliance.  Should the last and highest bidder fail or refuse to make the required deposit at the time of the bid or comply with the other terms or the bid within twenty (20) days, then the Special Referee may resell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the former highest bidder).  No personal or deficiency judgment being demanded, the bidding will not remain open after the date of sale, but compliance with the bid may be made immediately.

The successful bidder will be required to pay interest on the amount of the bid from the date of sale to date of compliance with the bid at the rate of 4.00% per annum.
