BY VIRTUE of a decree heretofore granted in the case of: Bayview Loan Servicing, LLC, a Delaware Limited Liability Company against Phillip E. Robinson, Juanita B. Robinson aka Juanita Boulware, and Philip C. Wilkins, DMD PC, I, the undersigned Special Referee for Fairfield County, will sell on August 14, 2017, at 11:00 a.m. at Fairfield County Courthouse in Winnsboro, South Carolina, to the highest bidder, the following described property, to-wit: All that certain piece, parcel or tract of land in Fairfield County, South Carolina, containing 2.12 acres, more or less, and being known as Lot #78 of Rion Ridge Subdivision, Phase III-A, as shown on subdivision plat dated December 21, 1998, prepared for Atlantic Coast Properties, Inc. by R. M. Gaddy and Associates, Inc., and being recorded in Plat Book 605 at Page 861, in the Office of the Clerk of Court for Fairfield County, South Carolina and being further described on plat dated October 31, 2006, prepared for Phillip E. Robinson and Juanita B. Robinson by Douglas E. Platt, Sr., SCRLS No. 4041. See referenced plat for metes and bounds. Being the same property conveyed to Phillip E. Robinson and Juanita B. Robinson, as joint tenants with the right of survivorship, by deed of Atlantic Coast Properties, Inc., dated November 7, 2006 and recorded January 19, 2007 in Deed Book 824 at Page 102. TMS No. 197-00-00-143-000 (per mortgage) 180-00-02-100-000 (per assessor) Property Address: 87 Hard Rock Road, Winnsboro, SC 29180 TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Special Referee at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of noncompliance. Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee may resell the property on the same terms and conditions (at the risk of the said defaulting bidder). Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or any Supplemental Order. The successful bidder will be required to pay for documentary stamps on the Deed and interest on the balance of the bid from the date of sale to the date of compliance with the bid at the rate of 6.5000%.
