NOTICE OF SALE 2017-CP-20-00068 BY VIRTUE of a decree heretofore granted in the case of: Bayview Loan Servicing, LLC, a Delaware Limited Liability Company against Michael A. Swink, Gaye Swink, and The South Carolina Department of Motor Vehicles, I, the undersigned Special Referee for Fairfield County, will sell on October 2, 2017, at 11:00 a.m. at the Fairfield County Courthouse in Winnsboro, South Carolina, to the highest bidder, the following described property, to-wit: All that certain piece, parcel or lot of land, together with any improvements thereon, situate, lying and being in the County of Fairfield, State of South Carolina, and containing 1.06 acres more or less. Said parcel being further described as Lot “B” on a plat entitled “Subdivision of Lands Owned by Betty M. Swink” prepared by W.D. Bozard, R.L.S., dated March 31, 1998 and recorded on March 31, 1998 on Plat Slide 580 at Page 1595 in the Office of Register of Deeds for Fairfield County. Also includes a mobile/manufactured home, a 1996 Pioneer, VIN: PH2401GA852A&B Being the same property conveyed to Michael A. Swink and Gaye Swink by deed of Betty M. Swink, dated August 30, 2001 and recorded September 5, 2001 in Deed Book RD at Page 199. TMS No. 104-00-02-090 (Land) 104-00-02-090.001 (Mobile Home) Property Address: 212 Softwood Drive, Winnsboro, SC 29180 TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Special Referee at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of noncompliance. Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee may resell the property on the same terms and conditions (at the risk of the said defaulting bidder). Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or any Supplemental Order. The successful bidder will be required to pay for documentary stamps on the Deed and interest on the balance of the bid from the date of sale to the date of compliance with the bid at the rate of 11.3400%.
