BY VIRTUE of a decree heretofore granted in the case of: Carrington Mortgage Services, LLC against Michael W. Dean aka Michael Wayne Dean, individually and as Personal Representative of the Estates of Robert F. Dean aka Robert Fredrick Dean, Sr. and Darlene P. Dean aka Darlene Porter Dean, Deceased, Fairfield Memorial Hospital and Citibank NA, I, the undersigned Special Referee for Fairfield County, will sell on August 13, 2018, at 11:00 a.m. at the Fairfield County Courthouse in Winnsboro, South Carolina, to the highest bidder, the following described property, to-wit: Land Situated in the Town of Winnsboro in the County of Fairfield in the State of SC: All that piece, parcel or lot of land, with the improvements thereon, situate lying and being on the Eastern side of Cathcart Circle, in the County of Fairfield, State of South Carolina, designated as Lot No. 9, in Block “F” on plat of Section Two of Belle View, made by B.P. Barber & Associates, dated July 24, 1962, revised February 14, 1964, and recorded in the Office of the Clerk of Court for Fairfield County in Plat Book “6” at Page 149, and also shown on a plat prepared by Isaac B. Cox, RLS dated October 29, 1965, and bounded as follows: On the North by Lot 10, measuring thereon 169.6 feet, on the East by Lots 4 and 5, measuring thereon 141.4 feet, on the South by Lots 7 and 8, measuring thereon 174.9 feet, and on the West by Cathcart Circle, measuring thereon 109.9 feet. ALSO: All that certain piece, parcel or lot of land, lying, being and situate in the Town of Winnsboro, County of Fairfield, State of South Carolina, on Cathcart Circle, and being shown and designated as Lot 10, Block F, on that certain plat of survey of the property of Elizabeth Coan Cathcart made by B.P. Barber & Associates, Inc., Engineers, dated July 24, 1962 and recorded February 29, 1964 in the Office of the Clerk of Court for Fairfield County in Book “6” of Plats at Page 149 and being bounded: On the Northeast by Lot 3 of Edgar C. Sims and Lot 4 of Vashti T. and Thurman C. Sims; on the Southeast by Lot 9 of the Grantees herein; on the Southwest by Cathcart Circle and on the Northwest by Lot 11 of Martha S. Woods. Tax Map #135-12-3-2. Less and Except: All that certain piece, parcel or lot of land, lying, being and situate in the Town of Winnsboro, County of Fairfield, State of South Carolina, on Marion Avenue, and being shown and designated as Lot 5, Block F, on that certain plat of survey of the property of Elizabeth Coan Cathcart made by B.P. Barber & Associates, Inc., Engineers, dated July 24, 1962 and recorded February 29, 1964 in the Office of the Clerk of County for Fairfield County in Book “6” of Plats at Page 149 and being bounded: On the Northeast by Marion Avenue; on the Southeast by Lot 6 of Martin L. and Dorothy H. Hair and Lot 7 of Donald J. and Caroline S. Anderson; on the Southwest by Lot 9 of the Grantees herein and on the Northwest by Lot 4 of Vashti T. and Thurman C. Sims. Being the same property conveyed unto Robert F. Dean and Darlene P. Dean by deed from Albert C. Garon and Martha Evelyn G. Garon, dated March 12, 1982 and recorded March 16, 1982 in Deed Book HA at Page 20 and a portion of property conveyed unto Robert F. Dean and Darlene P. Dean by deed from Marion C. Waters and John H. Cathcart, Jr. dated August 13, 1986 and recorded August 27, 1986 in Deed Book IV at Page 240 in the Office of the Clerk of Court for Fairfield County, South Carolina. Thereafter, Robert F. Dean died testate on July 22, 2015, leaving his interest in the subject property to his devisee, namely, Darlene P. Dean, as is more fully preserved in the Probate Records for Fairfield County, in Case No.: 2016ES2000191. Thereafter, Darlene P. Dean died testate on October 25, 2016, leaving the subject property to her devisee, namely, Michael W. Dean as is more fully preserved in the Probate Records for Fairfield County, in Case No.: 2016ES2000192. TMS No. 126-021-000-500 Property Address: 102 Cathcart Circle, Winnsboro, SC 29180 TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Special Referee at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of noncompliance. Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee may resell the property on the same terms and conditions (at the risk of the said defaulting bidder). Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or any Supplemental Order. The successful bidder will be required to pay for documentary stamps on the Deed and interest on the balance of the bid from the date of sale to the date of compliance with the bid at the rate of 5.3750%. THIS SALE IS SUBJECT TO ASSESSMENTS, COUNTY TAXES, EXISTING EASEMENTS, EASEMENTS AND RESTRICTIONS OF RECORD, AND OTHER SENIOR ENCUMBRANCES. No personal or deficiency judgment being demanded, the bidding will not remain open after the date of sale, but compliance with the bid may be made immediately.
