NOTICE OF SALE

Pursuant to the terms of the Special Referee’s Order of Foreclosure and Sale granted in the above entitled case, Special Referee M. Paul Swearingen will sell on the next sales day, the same being Tuesday, September 4, 2018, during

the usual hours of public sale, before me, at the Courthouse Steps at 101 South Congress Street, Winnsboro, SC 29180 to the highest bidder, for cash, the below-described property: All that piece, parcel or lot of land, with the improvements thereon, lying, being and situate near and north of the northern limits of the City of Winnsboro, County of Fairfield, State of South Carolina, on the eastern side of the Old Chester Road, fronting on said road one hundred ten (110’) feet and extending eastwardly therefrom between parallel lines one hundred seventy-five

(175’) feet; bounded on the north by lot, nor or formerly, of Patrick; on the east and south by lands, now or formerly, of the Estate of H. B. McMaster, deceased, and on the west by Evans Street Extension. Being the identical property conveyed to Sumber K. Ban by deed of Elma D. Denton, Patricia D. LeGrand, Josephine Johns-Creech and Maggie Jean Varn recorded in the Office of the Clerk of Court for Fairfield County August 23, 2006 in Record Book “798”at page

29180 TERMS OF SALE:  The successful bidder, other than the plaintiff, will deposit with  Special Referee M. Paul Swearingen, at conclusion of the bidding, five percent (5%) of the bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of non-compliance. If the Plaintiff’s representative is not in attendance at the scheduled time of the sale, the sale shall be canceled and the property sold on some subsequent sales day after due advertisement.  Should the last and highest bidder fail or refuse to make the required deposit at

time of bid or comply with the other terms of the bid within twenty (20) days, Special Referee  M. Paul Swearingen may re-sell the property on the same terms and conditions on some Subsequent Sales Day (at the risk of the said highest bidder).  As a deficiency judgment is being Waived, the bidding will not remain open thirty (30) days after the date of sale. Purchaser to pay For preparation of deed, documentary stamps on the deed, and recording of the deed. The successful bidder will be required to pay interest on the amount of the bid from date of sale to date of compliance with the bid at the rate of 5.25% per annum. Subject to assessments, taxes,  easements, easements and restrictions of record, and other senior encumbrances. The Plaintiff

does not warrant its title search to purchasers at foreclosure sale or other third parties, who should have their own title search performed on the subject property.
