NOTICE OF SALE 2018-CP-20-00108 BY VIRTUE of a decree heretofore granted in the case of: Ditech Financial LLC against Lonnie F. Dowd, I, the undersigned Special Referee for Fairfield County, will sell on October 1, 2018, at 11:00 a.m. at the Fairfield County Courthouse in Winnsboro, South Carolina, to the highest bidder, the following described property, to-wit: All that piece, parcel or tract of land, with improvements thereon, lying, being and situate in the State of South Carolina, County of Fairfield, located approximately 1.5 miles east of Longtown, containing a total of 5.65 acres, more or less, and is more particularly shown and designated on a plat for Kathryne S. Gardner, prepared by Daniel Riddick & Associates, Inc. dated March 23, 1998 and recorded in the Office of the ROD for Fairfield County in Plat Slide 581 at page 1604. Reference is hereby craved to latter said plat for a more complete and accurate description, be all measurements a little more or less. Being the same property conveyed to Lonnie F. Dowd by deed of Kathryne S. Gardner, dated December 13, 2004 and recorded December 21, 2004 in Deed Book 689 at Page 54. TMS No. 174-00-00-008 (per mortgage) 153-00-00-059-000 (per assessor) Property Address: 10992 Longtown Road, Ridgeway, SC 29130 TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Special Referee at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of noncompliance. Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee may resell the property on the same terms and conditions (at the risk of the said defaulting bidder). Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or any Supplemental Order. The successful bidder will be required to pay for documentary stamps on the Deed and interest on the balance of the bid from the date of sale to the date of compliance with the bid at the rate of 3.7500%. THIS SALE IS SUBJECT TO ASSESSMENTS, COUNTY TAXES, EXISTING EASEMENTS, EASEMENTS AND RESTRICTIONS OF RECORD, AND OTHER SENIOR ENCUMBRANCES. Since a deficiency judgment is being demanded, the bidding will remain open for thirty (30) days after the date of sale, pursuant to S.C. Code ANN. Section 15-39-720, (1976).
