NOTICE OF SALE 2019-CP-20-00003 BY VIRTUE of a decree heretofore granted in the case of: Nationstar Mortgage LLC d/b/a Mr. Cooper against Bruce Simons, and J.R. Douglas aka Jimmy Ray Douglas, I, the undersigned Special Referee for Fairfield County, will sell on July 9, 2019, at 11:00 a.m. at the Fairfield County Courthouse in Winnsboro, South Carolina, to the highest bidder, the following described property, to-wit: The land referred to herein is situated in the State of SC, County of Fairfield, City of Winnsboro and described as follows: Containing 17,576 square feet, more or less, and being particularly shown as Lot #8 upon that certain Plat prepared by W.D. Bozard, RLS, dated August 9, 1988, and recorded in the Office of the Clerk of Court for Fairfield County in Slide 438 at Page 176 and having such metes, bounds, courses, and distances as shown thereon, said Plat being incorporated herein by reference. Beginning at the Northeasterly corner and running Southeasterly for a distance of (192.15’) feet; thence cornering and running Southwesterly for a distance of (91.04’) feet; thence cornering and running Northwesterly for a distance of (183.43’) feet; thence cornering and running Northeasterly for a distance of (98.64’) feet to the beginning point. All measurements being a little more or less. This is the same property conveyed unto Bruce Simons by deed from Evelyn Ashford Kelly dated January 28, 1999 and recorded February 19, 1999 in Deed Book PO at Page 339 in the Office of the Clerk of Court for Fairfield County, South Carolina. TMS No. 196-00-03-007-000 Property Address: 1259 Evergreen Road, Winnsboro, SC 29180 TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Special Referee at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of noncompliance. Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee may resell the property on the same terms and conditions (at the risk of the said defaulting bidder). Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or any Supplemental Order. The successful bidder will be required to pay for documentary stamps on the Deed and interest on the balance of the bid from the date of sale to the date of compliance with the bid at the rate of 4.0000%. THIS SALE IS SUBJECT TO ASSESSMENTS, COUNTY TAXES, EXISTING EASEMENTS, EASEMENTS AND RESTRICTIONS OF RECORD, AND OTHER SENIOR ENCUMBRANCES. Since a deficiency judgment is being demanded, the bidding will remain open for thirty (30) days after the date of sale, pursuant to S.C. Code ANN. Section 15-39-720, (1976).
