BY VIRTUE of a Decree, I, John E. James, III, Esq., the undersigned, Special Referee for Fairfield County, will sell on July 1, 2019, at 11:00 A.M., or shortly thereafter, at the FAIRFIELD COUNTY COURTHOUSE, 101 South Congress St, Winnsboro, SC 29180, South Carolina, to the highest bidder for cash, at public auction, the premises fully described below:
THE LAND REFERRED TO HEREIN BELOW IS SITUATED IN THE COUNTY Of FAIRFIELD, STATE OF SOUTH CAROLINA, AND IS DESCRIBED AS FOLLOWS:
ALL THAT CERTAIN PARCEL OR LOT OF LAND WITH THE DWELLING HOUSE AND OTHER IMPROVEMENTS THEREON LYING, BEING AND SITUATE ON POPLAR STREET, NEAR WINNSBORO, IN FAIRFIELD COUNTY, IN THE STATE OF SOUTH CAROLINA, DESIGNATED AS LOT NO. 1903 ON A PLAT BY SOUTHERN MAPPING AND ENGINEERING COMPANY, DATED JULY, 1946, RECORDED IN THE OFFICE OF THE CLERK OF COURT FOR FAIRFIELD COUNTY IN BOOK “4” Of PLATS AT PAGE 65, 67, AND 71, AND ALSO KNOWN AS 240 POPLAR STREET; BOUNDED ON THE EAST BY SAID STREET, MEASURING THEREON ONE HUNDRED (l00’) FEET AND EXTENDING WESTWARDLY THEREON BETWEEN PARALLEL LINES ONE HUNDRED FIFTY-SIX AND FORTY-TWO ONE HUNDREDTHS (156.42’) FEET; BOUNDED ON THE NORTH BY LOT NO. 1904, ON THE SOUTH BY LOT NO. 1902, ON THE WEST BY LOT NO. 1910, AND BY LOT NO. 1909.
THIS BEING THE SAME PROPERTY CONVEYED TO DOUGLAS O. HUGGINS AND TERESA S. HUGGINS BY DEED OF LINDSEY E. BRANHAM RECORDED IN THE OFFICE Of THE CLERK OF COURT FOR FAIRFIELD COUNTY ON DECEMBER 4, 1974 INDEED BOOK ‘’EM’ AT PAGE 558. SUBSEQUENTLY, THE INTEREST OF TERESA S. HUGGINS WAS CONVEYED TO DOUGLAS O. HUGGINS BY DEED OF DISTRIBUTION DATED JANUARY 31, 2007 AND RECORDED FEBRUARY 5, 2007 IN BOOK 827 AT PAGE 307 OF THE FAIRFIELD COUNTY REGISTER OF DEEDS.
TOGETHER WITH ALL AND SINGULAR, THE RIGHTS, MEMBERS, HEREDITAMENTS AND APPURTENANCES TO THE SAID PREMISES/PROPERTY BELONGING, OR IN ANYWISE INCIDENT OR APPERTAINING.

This sale shall be subject to taxes and assessments due on the day of such sale, existing easements and restrictions of record.
The property shall be sold for cash to the highest bidder. The highest bidder, other than the Plaintiff, will be required to deposit with the Special Referee, at the conclusion of the bidding, cash or certified check in the amount of five (5%) percent of the bid: the said deposit to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to Plaintiff’s debt in case of non-compliance.
Should the highest bidder fail or refuse to make the required deposit at the time of the bid or comply with the other terms of the bid within thirty (30) days from the date of sale, the Special Referee will resell the property at the risk and expense of the defaulting bidder upon the same terms as above set out. The Sheriff of Fairfield County may be authorized to put the purchaser into possession of the premises if requested by the purchaser.
Purchaser to pay for the preparation of the Special Referee’s Deed, documentary stamps on the deed, recording of the deed, and interest to be figured on the balance of the bid from the date of sale to date of compliance with the bid at the legal rate of interest for judgments (9.50% per annum).
