By virtue of a decree of the Court of Common Pleas for Fairfield County, heretofore granted in the case of The Mortgage Centre, Inc. vs. Jennifer Wilburn, auctioneer Carol Tolen, will sell on my behalf, on September 3, 2019, at 11:00 o’clock a.m. at the County Courthouse, Winnsboro, South Carolina, to the highest bidder, the following described property, to the highest bidder, the following described property:

All that certain piece, parcel or lot of land lying and being approximately 7.3 miles south of the Town of Winnsboro, in the County and State aforesaid, containing 0.87 acres; said lot beginning on the southwest side of an unnamed and unpaved community road at about 0.4 mile southeast side of an unnamed and unpaved county road and at an iron stake that marks the common corner of this lot and lot of Nathan Ashford and land of B. English Lyles thence running N. 53° 00’ E along lot of Nathan Ashford for a distance of 208.6 feet to an iron stake thereby crossing said community road thence turning and running S18° 27’ E along other lands of the grantor for a distance of 205.0 feet to an iron stake thence turning and running S53° 23’ W along other land of the grantor for a distance of 205.0 feet to an iron stake thence turning and running N 08° 04’ W along land of B. English Lyles for a distance of 138.1 feet to an iron stake thence slightly turning and running N 40° 00’ W along land of B. English Lyles for a distance of 75.0 feet to the iron stake at the point of beginning. Said lot being more fully described and delineated on plat of Lot surveyed for Margaret Johnson & Joseph Johnson by Dewey H Campbell, Jr. dated April 14, 1969.

This is the same property conveyed to Jennifer Wilburn by deed recorded in Deed Book 890, page 185, on February 4, 2008.

TERMS OF SALE: For cash the auctioneer will require a deposit of 5% of the amount of the bid (in cash or equivalent), same to be applied on the purchase price only upon compliance with the bid, but in case of non-compliance within thirty (30) days, same to be forfeited and applied to the costs and plaintiff’s debt and the property re-advertised for sale upon the same terms. The sale is to be made subject to any liens for taxes and any special assessments of record against such property; also, subject to payment by the purchaser of interest at 22.0% on the balance of the bid from the date of sale to the date of compliance with the bid; and for preparation of the deed and deed stamps; also, subject to any existing easements or restrictions of record.

No personal or deficiency judgment being demanded, the bidding will not remain open after the date of sale, but compliance with the bid may be made immediately.

The sale will not be held unless the Plaintiff or its attorney is present at the sale or has advised the Special Referee’s office of its bidding instructions.
