BY VIRTUE of a judgment heretofore granted in the case of Palmetto Citizens Federal Credit Union v. Adam C. Powell, I, Carol A. Tolen, the Special Referee for Fairfield County, will sell on Monday, December 2, 2019, at 11:00 A.M. at the Fairfield County Courthouse, 101 S. Congress Street, Winnsboro, South Carolina 29180 to the highest bidder:

All that certain piece, parcel, or lot of land, with the improvements thereon, situate, lying and being on the Northern side of State Road S-20-653 in the County of Fairfield, State of South Carolina, being shown and designated on a plat prepared by W.D. Bozard, RLS dated April 22, 1974, and recorded April 25, 1974 in the Office of the Clerk of Court for Fairfield County in Plat/Record Book EK at Page 299; said lot having such boundaries and measurements as shown thereon, all being a little more or less.

Also:

All that certain piece, parcel or lot of land lying, being and situate in the State of South Carolina, County of Fairfield, containing .03 acres of an acre, more or less and being more particularly shown on a plat prepared for Wilbur Coleman by W.D. Bozard, RLS, dated March 5, 1988 and recorded April 18, 1988 in Book JT at Page 259.

This being the identical property conveyed to Adam C. Powell by Deed of Marcus Dwaine Alston, dated August 14, 2009, and recorded August 31, 2009, in Book 965, Page 183, Fairfield County records.

SUBJECT TO ASSESSMENTS, COUNTY TAXES, EXISTING EASEMENTS, EASEMENTS AND RESTRICTIONS OF RECORD, AND OTHER SENIOR ENCUMBRANCES, IF ANY.

TERMS OF SALE:  The successful bidder, other than the Plaintiff, will deposit with the Special Referee at conclusion of the bidding, five (5%) of his bid, in cash or equivalent, as evidence of good faith, the same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to Plaintiff’s debt in the case of noncompliance.  Should the last and highest bidder fail or refuse to make the required deposit at the time of the bid or comply with the other terms or the bid within twenty (20) days, then the Special Referee may resell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the former highest bidder).  A personal or deficiency judgment being demanded, the bidding will remain open for thirty (30) days after the date of sale; however, the Plaintiff herein reserves its right to waive the said deficiency judgment up to and including the day of sale, in which case, said bidding will not remain open for the additional 30-day period.  The successful bidder will be required to pay interest on the amount of the bid from the date of sale to date of compliance with the bid at the rate of 7.75% per annum.  If Plaintiff or Plaintiff’s representative does not appear at the above-described sale, then the sale of the property will be null, void, and of no force and effect. In such event, the sale will be rescheduled for the next available sales day. The Plaintiff may waive any of its rights, including its right to a deficiency judgment, prior to sale.
