Notice of Sale: 2019-CP-20-00275


BY VIRTUE of a decree heretofore granted in the case of The Citizens Bank, Plaintiff, vs. Shawn D. Rioux, Rioux Industries, LLC, JHHR, LLC and Wells Fargo Bank, National Association, Defendants, CA# 2019-CP-20-00275, I, the undersigned, will sell on December 2, 2019 at 11:00 a.m., at the Fairfield County Courthouse, 101 South Congress Street, Winnsboro, South Carolina, to the highest bidder the following property:

TRACT I – Shawn D. Rioux- All those pieces, parcels or tracts of land, lying, being and situate at Lake Wateree, in the County of Fairfield, State of South Carolina, being shown and delineated as Lots 48 and 49, Molly Creek as shown on plat prepared for The Woods at Molly Creek by Dennis Corporation dated November 9, 2010 and recorded in the Office of the ROD for Fairfield County in Slide 605 at Page 2037. Reference being made to said plat which is incorporated herein by reference for a more complete and accurate description; be all measurements of title more or less.

This being the same property conveyed to Shawn D. Rioux by deed of ABC Investment Properties, LLC dated November 15, 2010 and recorded November 15, 2010 in Book 18 at Page 275.

TRACT II – Rioux Industries, LLC – All that piece, parcel or tract of land, lying, being and situate at Lake Wateree, in the County of Fairfield, State of South Carolina, consisting of six and no/100 (6.00) acres, more or less, and being more particularly shown and described on the Boundary Survey for Crescent Resources, LLC by CBS Surveying & Mapping, Inc., dated May 14, 2003 and recorded in the Office of the ROD for Fairfield County in Slide 605 at Page 781 and having such metes, courses and distances as are delineated and shown according to said plat, reference to which is hereby made pursuant to authority contained in Section 30-5-250 of the Code of Laws of South Carolina, 1976, as amended.

ALSO: All that certain tract of land located in Longtown Township, Fairfield County, South Carolina, designated as “TR #5330.34, AREA=5.01 ACRES” on plat recorded in Plat Slide 605, Page 1871; and being all or a portion of the land conveyed to Wateree Power Company (presently known as Duke Energy Carolinas, LLC) by Deed of George D. Belton (WA-10) recorded in Deed Book BC, Page 267; and by Deed to Crescent Land & Timber Corp. (presently known as Crescent Resources, LLC) from Duke Power Company (presently known as Duke Energy Carolinas, LLC) recorded in Deed book DU, Page 215.

These being the same properties conveyed to Rioux Industries, LLC by deed of S. Dee Cook dated August 25, 2010 and recorded August 27, 2010 in Record Book 1003 at Page 241 .

PERSONAL PROPERTY:  All furniture and fixtures located at 83 Doe Run Lane, Ridgeway, SC.

TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit, at the conclusion of the bidding, five percent (5%) of the bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to Plaintiff’s debt in the case of non-compliance. Should the last and highest bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the property will be resold on the same terms and conditions on some subsequent Sales Day at the risk of the said highest bidder. Personal or deficiency judgment having been demanded, the bidding will remain open for a period of 30 days after the sale. Purchaser to pay for preparation of the deed, documentary stamps on the deed, and recording fees.
