NOTICE OF SALE 2016-CP-20-00182 BY VIRTUE of a decree heretofore granted in the case of: U.S. Bank National Association, as Indenture Trustee for CIM Trust 2015-3AG Mortgage-backed Notes, Series 2015-3AG against Sandra Sodl aka Sandra R. Sodl, individually and as Personal Representative of the Estate of George Sodl aka George T. Sodl, Sr., Deceased, Bridget Pike, George T. Sodl, Jr. and CFNA Receivables (SC), Inc. fka CitiFinancial, Inc., I, the undersigned Special Referee for Fairfield County, will sell on February 6, 2017, at 11:00 a.m. at Fairfield County Courthouse in Winnsboro, South Carolina, to the highest bidder, the following described property, to-wit: All that certain piece, parcel or tract of land, together with appurtenance thereon, lying, being and situate in the State of South Carolina, County of Fairfield, North of Dutchman’s Creek, containing two and seventy-eight hundredths (2.78) acres, more or less, and bound as follows: North by dirt road twenty (20) feet in width; said northern boundary being four hundred (400) feet, more or less; East by Road S-20-317 for three hundred (300) feet, more or less; South by land now or formerly of A.H. Rion for a distance of three hundred thirty (330) feet, more or less; West by lands of A. H. Rion and a branch for a distance of three hundred (300) feet, more or less. This being the same property conveyed to George T. Sodl, Sr. by deed of Carmen J. Clark dated December 17, 1987 and recorded December 18, 1987 in Deed Book JO at Page 45, in the Clerk of Court’s Office for Fairfield County, SC. Thereafter, George T. Sodl Sr. died testate on June 10, 2014, leaving the subject property to his devisees, namely, Sandra R. Sodl, Bridget Pike and George T. Sodl, Jr., as is more fully preserved in the Probate Records for Fairfield County, in Case No.: 2014-ES-20-00154. TMS No. 095-03-01-044-000 Property Address: 1688 Wateree Estates Road, Winnsboro, SC 29180 TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Special Referee at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of noncompliance. Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee may resell the property on the same terms and conditions (at the risk of the said defaulting bidder). Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or any Supplemental Order. The successful bidder will be required to pay for documentary stamps on the Deed and interest on the balance of the bid from the date of sale to the date of compliance with the bid at the rate of 7.5000%.
