NOTICE OF SALE 2016-CP-20-00424 BY VIRTUE of a decree heretofore granted in the case of: Nationstar Mortgage LLC against Minnie L. Martin, individually and as Personal Representative of the Estate of Chambers Harrison; Thomas L. Harrison, Jr., Richard A. Harrison, Johnnie Mae Jackson, Ulysee Harrison, Betty H. Able, David Harrison, Bobby Harrison, Sr., Melvina J. Harrison-Cotton, Beverly Harrison, Cassandra Boulware, and any other Heirs-at-Law or Devisees of Chambers Harrison, Deceased, their heirs, Personal Representatives, Administrators, Successors and Assigns, and all other persons entitled to claim through them; all unknown persons with any right, title or interest in the real estate described herein; also any persons who may be in the military service of the United States of America, being a class designated as John Doe; and any unknown minors or persons under a disability being a class designated as Richard Roe, FIA Card Services, Comprehensive Legal Solutions, Inc., Brice’s Plumbing & Electric Co., Inc., Discover Bank and First National Bank of Omaha, I, the undersigned Special Referee for Fairfield County, will sell on June 5, 2017, at 11:00 a.m. at Fairfield County Courthouse in Winnsboro, South Carolina, to the highest bidder, the following described property, to-wit: All that certain parcel of land, with all the buildings and improvements thereon, situate in or near the Town of Winnsboro, in the County of Fairfield, State of South Carolina, shown on Property Map showing Housing layout of United States Rubber Company, Winnsboro Mills, Fairfield County, South Carolina, by Southern Mapping & Engineering Company of Greensboro, North Carolina, dated July, 1946, as Lot No. 1102 in Block “1100” said Plat being recorded in the Office of the Clerk of Court for Fairfield County in Book “4” of Plats at pages 65-67, 71. Also, shown on a re-survey plat made by Oliver Johnson, RLS, on May 10, 1960, and recorded in said Clerk’s Office in Book “CX” of Deeds at page 186. Being the same property conveyed unto Chambers Harrison by deed from Darlene F. Clawson dated October 19, 2005 and recorded October 20, 2005 in Deed Book 745 at Page 109 in the Office of the Clerk of Court for Fairfield County, South Carolina. Thereafter, Chambers Harrison died intestate on April 26, 2016, leaving the subject property to his heirs at law, namely, Thomas L. Harrison, Jr., Richard A. Harrison, Johnnie Mae Jackson, Ulysee Harrison, Betty H. Able, David Harrison, Bobby Harrison, Sr., Melvina J. Harrison-Cotton, Beverly Harrison, Cassandra Boulware and Minnie L. Martin, as is more fully preserved in the Probate Records for Fairfield County, in Case No.: 2016ES2000109. TMS No. 151-11- 12-007 (per Mortgage) 145-01-15-008 (per County Assessor) Property Address: 560 Columbia Road, Winnsboro, SC 29180 TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Special Referee at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of noncompliance. Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee may resell the property on the same terms and conditions (at the risk of the said defaulting bidder). Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or any Supplemental Order. The successful bidder will be required to pay for documentary stamps on the Deed and interest on the balance of the bid from the date of sale to the date of compliance with the bid at the rate of 6.3800%.
