NOTICE OF SALE 2016-CP-20-00406 BY VIRTUE of a decree heretofore granted in the case of: US Bank National Association as Trustee for CRMSI REMIC Series 2006-01 – REMIC Pass-Through Certificates Series 2006-01 against Christon Renee Gaddy, Individually and as Personal Representative of the Estate of Vernon Leroy Hudson, Sr. aka Vernon Leroy Hudson; Frances Lee Hudson aka Frances Hudson, Dawn H. McDonald, Vernon L. Hudson, Jr., and Audrey R. Lucas, and any other Heirs-at-Law or Devisees of Vernon Leroy Hudson, Sr. aka Vernon Leroy Hudson, Deceased, their heirs, Personal Representatives, Administrators, Successors and Assigns, and all other persons entitled to claim through them; all unknown persons with any right, title or interest in the real estate described herein; also any persons who may be in the military service of the United States of America, being a class designated as John Doe; and any unknown minors or persons under a disability being a class designated as Richard Roe, Republic Finance, LLC, and Fairfield Memorial Hospital, I, the undersigned Special Referee for Fairfield County, will sell on September 6, 2017, at 11:00 a.m. at the Fairfield County Courthouse in Winnsboro, South Carolina, to the highest bidder, the following described property, to-wit: All that certain piece, parcel, or lot of land lying, being, and situate in the County of Fairfield, State of South Carolina, designated as Lot No. 20 on a plat made by James C. Covington, CE, dated November 12, 1943, and recorded in the Office of the Clerk of Court for Fairfield County in Plat Book 1 at Page 201, and bounded on the North by lands, now or formerly, of Douglas; on the East by Lot No. 18 on said plat; on the Southeast by Lot No. 19 on said plat; on the Southeast by a street shown on said plat; and on the Northwest by Lot No. 21 on said plat, see Plat Book 5, Page 13. Being the same property conveyed to Vernon Leroy Hudson by deed of Vernon Leroy Hudson, as Personal Representative of the Estate of Admiral Dewey Hudson, Jr., dated April 27, 1995 and recorded April 28, 1995 in Deed Book NK at Page 207; Thereafter, Vernon Leroy Hudson, Sr. aka Vernon Leroy Hudson died intestate on April 27, 2016, leaving the subject property to his heirs at law or devisees, namely, Frances Lee Hudson aka Frances Hudson, Christon Renee Gaddy, Dawn H. McDonald, Vernon L. Hudson, Jr., and Audrey R. Lucas, as is more fully preserved in the Probate Records for Fairfield County, in Case No.: 2016ES2000119. TMS No. 107-03-06-030 Property Address: 82 Robinson Avenue, Winnsboro, SC 29180 TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Special Referee at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of noncompliance. Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee may resell the property on the same terms and conditions (at the risk of the said defaulting bidder). Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or any Supplemental Order. The successful bidder will be required to pay for documentary stamps on the Deed and interest on the balance of the bid from the date of sale to the date of compliance with the bid at the rate of 8.9660%.
