AMENDED NOTICE OF
SPECIAL REFEREE’S SALE

STATE OF SOUTH CAROLINA
FAIRFIELD COUNTY
COURT OF COMMON PLEAS

Pursuant to Court Decree in Atlantic Coast Properties, LLC, Plaintiff vs. Derrick A. Gillard and Tracey L. Gillard, Defendants, I will sell at public auction to highest bidder at County Court House on October 2, 2017, at 11:00 o’clock a.m., the following property:
Property situate and being in the aforesaid County and State, measuring and containing 2.39 acres, known as Lot #1 of Riding Ridge Phase Subdivision 1-A, shown and designated on that plat, dated January 4, 1999, by R.M. Gaddy and Associates, Inc., recorded in Slide 605 at Page 6970 in the Office of the Clerk of Court for Fairfield County, South Carolina.
ALSO INCLUDED a 2000 Clayton Jamestown, Serial Number #CNF004375NCAB, mobile/manufactured home. (See Judgment for full property description). 48 Pioneers Trail, Ridgeway, SC; TMS: 2150001-086.
The property will be sold subject to any past due or accruing property taxes and assessments, existing easements and restrictions, easements and restrictions of record and any other senior encumbrances.
The successful bidder, other than the Plaintiff, will deposit with the Special Referee, at conclusion of the bidding, five percent (5%) of his bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to the Plaintiff’s debt in the case of non-compliance. Should the last and highest bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within twenty (20) days, then the Special Referee may re-sell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the said highest bidder). Deficiency Judgment being demanded the bidding will not be closed on the day of sale but will remain open for a period of thirty (30) days as provided by law. Plaintiff reserves the right to waive deficiency judgment up to the time of sale. Purchaser to pay for documentary stamps on the Special Referee’s Deed. The successful bidder will be required to pay interest on the amount of the bid from date of sale to date of compliance with the bid at the rate of 12.5% per annum.
In the event that a representative of the Plaintiff is not present at the time set for the foreclosure sale, the property will be withdrawn from foreclosure sale and any sale by the selling officer without the presence of the Plaintiff’s representative shall be null and void.
