Fairhaven Properties, LLC, Zelma Taylor, Cora Lee Mayes Peeples a/ka Cora Lee Mayes Peoples, Shirley M. Lenoir a/k/a Shirley Lenoirr a/k/a Shirley M. Lenoir (Per. Rep.) and all other persons or entities unknown or claiming any right, title, interest, estate in, or lien upon the real property herein, and any unknown adults, being as a class designated as John Doe; and any unknown infants or persons under disability, being as a class designated as Richard Roe, Defendants.

TO:  THE DEFENDANT(S), ABOVE-NAMED:

YOU ARE SUMMONED and REQUIRED to Answer the Complaint in this matter, a copy of which is herewith served upon you, and to serve a copy of your ANSWER to said Complaint upon the subscriber at his office, 1700 Sunset Boulevard, P.O. Box 5709, West Columbia, South Carolina, 29171 within thirty (30) days from the service thereof, exclusive of the day of such service; and if you fail to answer the COMPLAINT within the time aforesaid, judgment by default will be rendered against you for the relief demanded in the Complaint, plus interest and costs.

YOU WILL ALSO TAKE NOTICE that Plaintiff will move for an order of reference or that the Court may issue a general order of reference of this action to a Master-in-Equity/ special referee, pursuant to Rule 53, of the South Carolina Rules of Civil Procedure.

LIS PENDENS ACTION TO QUIET TITLE

TO: THE DEFENDANTS, ABOVE-NAMED:

NOTICE IS HEREBY GIVEN that an action has been commenced and is now pending in this Court upon the claim of the Plaintiff against the above-named Defendant(s) to have a title of real property quieted in the name of the Plaintiff. The real property which is the subject of this action is described as follows:

Tract B Kennedy Road, Jenkinsville, South Carolina

All that certain piece, parcel or lot of land with the improvements thereon, situate lying and being in the County of Fairfield, State of South Carolina, being designated as Tract B” containing 31.12 acres, more or less, on a plat prepared for Fairhaven Properties, LLC, by Glenn Associates Surveying, Inc., dated November 30, 2009, and recorded in the Office of the RMC for Fairfield County in Plat Book 605, at Page 1942, reference being made to said plat, which plat is incorporated herein by reference, for a more complete and accurate description; be all measurements a little more or less.

Also to include an easement for ingress and egress as shown on the aforementioned plat recorded in Fairfield County Plat Book 605, at Page 1942.

MOTION AND ORDER OF APPOINTMENT OF GUARDIAN AD LITEM NISI

WHEREAS, the Plaintiff in this action brings suit to quiet title, and

WHEREAS, the remaining Defendants to be joined as party Defendants herein under the fictitious names of John Doe (adults), and Richard Roe (infants, insane persons and incompetents), if any, and

WHEREAS, such Defendants require a Guardian Ad Litem to represent their interests, if any; therefore, an appointment for counsel/guardian ad litem is necessary; and

WHEREAS, Cassandra L. Hutchens, Esq., having an address at 21 Gamecock Ave., Suite A, Charleston, SC 29407, has been found to be without a conflict of interest in the representation of Defendants John Doe and Richard Roe.

IT IS HEREBY ORDERED that Attorney Cassandra L. Hutchens, serve as Guardian Ad Litem for Defendants John Doe and Richard Roe.
