NOTICE OF FORECLOSURE SALE

WHITE INTERESTS LIMITED PARTNERSHIP, Plaintiff,

vs.

WHITNEY L. CAIN, Defendant.

By virtue of an Order of Foreclosure and Sale hereinbefore granted in the case above named, Case Number 2018-CP-20-00021, I, the undersigned Special Referee for Fairfield County, will sell on October 1, 2018 at 11:00 a.m., or at any subsequent sales date hereinafter scheduled, at the Fairfield County Courthouse located at 101 S. Congress St, Winnsboro, South Carolina, to the highest bidder, for cash in hand, all the right, title and interest in the following described property:

All that certain piece, parcel or lot of land, with improvements thereon, situate, lying and being in the County of Fairfield, State of South Carolina, the same being shown as Lot on plat prepared for Ted O McGee Real Estate Company by W.A. Whitworth, RLS, dated 04/19/1972 to be recorded, and having the following boundaries and measurements.

Bounded on the Northwest by property now or formerly of Belton, whereon it measure One Hundred Twenty (120’) feet; on the Southeast by property now or formerly of Belton, whereon it measure Three Hundred Twenty and Three-tenths (320.3’) feet; on the Southwest by Brunson Road, whereon it measure One Hundred Forth (sic) and Seven-tenths (140.7’) feet (in a broken line); and on the Northwest by property now or formerly of Belton, whereon in measure Two Hundred Fifty (250’) feet.

Derivation: Being the property conveyed to Whitney L. Cain by deed from Roxie Nash dated July 30, 2015, recorded in the Office of the Register of Deeds for Fairfield County, South Carolina, in Book 1201 at Page 173.

TERMS OF SALE:  The successful bidder, other than the Plaintiff, will deposit with the Special Referee, at the conclusion of the bidding, five percent (5%) of the bid, in cash or its equivalent as evidence of good faith, same to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to the Plaintiff’s debt in the case of noncompliance.  Should the last and highest bidder fail or refuse to make the required deposit at the time of bid or fail to comply with the other terms of the bid within twenty (20) days, the Special Referee may resell the property on the same terms and conditions on a subsequent sales day at the risk of said highest bidder. Interest shall run from the date of sale to the date of compliance with the bid.

The lien being foreclosed is a first lien on the property.  The property is to be sold subject to taxes due thereon, and any other restrictions and easements of public record. A deficiency judgment is not sought in this case; therefore the bidding shall conclude on the sale day.

The purchaser at sale is to pay for all documentary stamps and recording fees on the deed.
