NOTICE OF SALE 2018-CP-20-00270 BY VIRTUE of a decree heretofore granted in the case of: Bayview Loan Servicing, LLC, a Delaware Limited Liability Company against Joseph Ray Edwards a/k/a Joseph R. Edwards, individually and as Personal Representative of the Estate of Gail Edwards a/k/a Rhetta Branham Edwards a/k/a Rhetta Gail Edwards; Jennifer Edwards a/k/a Jennifer Jackson a/k/a Jennifer E. Curran, and any other Heirs-at-Law or Devisees of Gail Edwards a/k/a Rhetta Branham Edwards a/k/a Rhetta Gail Edwards, Deceased, their heirs, Personal Representatives, Administrators, Successors and Assigns, and all other persons entitled to claim through them; all unknown persons with any right, title or interest in the real estate described herein; also any persons who may be in the military service of the United States of America, being a class designated as John Doe; and any unknown minors or persons under a disability being a class designated as Richard Roe, I, the undersigned Special Referee for Fairfield County, will sell on January 7, 2019, at 2:00 p.m. at the Fairfield County Courthouse in Winnsboro, South Carolina, to the highest bidder, the following described property, to-wit: The following described property, to-wit: all my right, title and interest, in and to: All those certain lots or parcels of land lying, being and situate in the County of Fairfield, State of South Carolina, approximately Two (2) miles South of the Town of Winnsboro, shown and designated as Lots Number 116 and 117 on a plat of survey of the Subdivision of the Estate of C.E. Strange by James C. Covington, C.E. dated November 18, 1944 and recorded in the Office of the Clerk of Court for Fairfield County in Book 4 of Plats at Pages 19 and 20; said Lots being bounded on the North by Winter Street, on the East by Lot Number 115; On the South by Lots Number 124 and 125; and on the West by Lots Numbered 118, 119 and 120. This being the same property conveyed to Gail Edwards and Linda Branham, as trustees for the benefit of Tiwanna Edwards and Jennifer Edwards by deed of Norman Branham, recorded October 25, 1977 in Deed Book EX at page 133; Thereafter, Tiwanna Edwards a/k/a Tiwanna E. Beasley died intestate on March 5, 1994, leaving the subject property to her heirs at law or devisees, namely, Darin L. Beasley, by Deed of Distribution dated August 7, 1997, and recorded August 8, 1997 in Deed Book OR at Page 56; thereafter Darin L. Beasley conveyed his interest in the subject property to Gail Edwards by deed dated November 7, 1997, recorded November 11, 1997 in Deed Book OU at page 226; thereafter Jennifer Edwards a/k/a Jennifer Jackson conveyed her interest in the subject property to Gail Edwards by deed dated April 18, 1997, recorded April 24, 1997 in Deed Book OM at page 239; Thereafter, Gail Edwards a/k/a Rhetta Branham Edwards a/k/a Rhetta Gail Edwards died intestate on August 6, 2016, leaving the subject property to her heirs at law or devisees, namely, Joseph Ray Edwards and Jennifer Edwards a/k/a Jennifer Jackson a/k/a Jennifer E. Curran. TMS No. 145-02-05-001-000 Property Address: 158 Winter Street, Winnsboro, SC 29180 TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Special Referee at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of noncompliance. Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee may resell the property on the same terms and conditions (at the risk of the said defaulting bidder). Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or any Supplemental Order.
