NOTICE OF SALE

(Deficiency Demanded)

BY VIRTUE of a decree heretofore granted in the case of: B. Todd Heniford, as Plaintiff, v. ABC Investment Properties, LLC, as Defendant, Civil Action Number 2018-CP-20-00385, I, the undersigned Special Referee for Fairfield County, will sell on Monday, June 3, 2019, at 11:00 o’clock a.m., at the Fairfield County Courthouse Office, 101 South Congress Street, Winnsboro, SC  29180 to the highest bidder:

All those certain pieces, parcels or lots of land, together with any improvements thereon, situate, lying and being in the County of Fairfield, State of South Carolina, said properties being more particularly shown as Lots 72 and 73 on a Final Plat of “Woods at Molly Creek, Phase 5” prepared for ABC Investment Properties, LLC by Cox and Dinkins dated October 23, 2014 and recorded in the Office of the Clerk of Court for Fairfield County in Book 605 at Page 2448. Reference to said plat is made for a more complete and accurate description. Be all measurements a little more or less.

This being a portion of that property conveyed to ABC Investment Properties, LLC by deed of Crescent Resources, LLC dated October 23, 2007 and recorded October 30, 2007 in Book 874 at Page 150.

TERMS OF SALE:  The successful bidder, other than the plaintiff, will deposit with the Special Referee, at conclusion of the Bidding, five percent (5%) of his bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of non-compliance.  Should the last and highest bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee may re-sell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the said highest bidder). Purchaser to pay for documentary stamps on the Special Referee’s Deed.  The successful bidder will be required to pay interest on the amount of the bid from date of sale to date of compliance with the bid at the rate set forth in the Note.  Deficiency having been demanded, bidding shall remain open for thirty (30) days after the date of sale.  However, Plaintiff reserves the right to waive deficiency at any time prior to sale.  Further, you will please take notice that if no representative of the Plaintiff is present at the sale, said sale shall be rescheduled for the next available sale date.  THIS PROPERTY IS BEING SOLD ON AN “AS-IS, WHERE-IS” BASIS WITHOUT REPRESENTATION OR WARRANTY AS TO ANY MATTERS OF TITLE OR OTHERWISE. A COMPLETE AND THOROUGH TITLE EXAMINATION IS RECOMMENDED PRIOR TO BIDDING ON THIS PROPERTY.  THE SALE OF THIS PROPERTY IS SUBJECT TO ANY TAXES, LIENS, ECUNMBRANCES, INTERESTS, ASSESSMENTS, AND THE LIKE OF RECORD, ALL OF WHICH MAY BE REVEALED BY A TITLE EXAMINATION.
