NOTICE OF SALE 2019-CP-20-00280 BY VIRTUE of a decree heretofore granted in the case of: The Bank of New York Mellon Trust Company National Association as Trustee against Thomas A. Evans, I, the undersigned Special Referee for Fairfield County, will sell on December 2, 2019, at 11:00 a.m. at the Fairfield County Courthouse in Winnsboro, South Carolina, to the highest bidder, the following described property, to-wit: All that lot of land about three (3) miles South of the present corporate lines of the Town of Winnsboro, County of Fairfield, State of South Carolina, and being shown and designated as Lot #9 on Plat of the Roddy Place Subdivision made by Van T. Cribbs, RLS, dated December 19, 1992 and recorded in the Office of the Clerk of Court for Fairfield County in Slide 502, Page 816, and shown thereon is bounded on the Northerly side by lands now or formerly of Rabon, whereon it measures 235.05 feet; on the Easterly side by Lot #10 by the right of way of circle at end of Oxner Road, on the Southerly side by Lot #8 whereon it measures 209.67 feet, and on the Westerly side by lands now or formerly of King, whereon it measures 206.74 feet. Evans by deed of Steve Jones dated June 13, 1997 and recorded June 26, 1997 in Deed Book OP at Page 183 in the Office of the Clerk of Court for Fairfield County. TMS No. 164-03-03-013.000 Property Address: 210 Oxner Road, Winnsboro, SC 29180 TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Special Referee at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of noncompliance. Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee may resell the property on the same terms and conditions (at the risk of the said defaulting bidder). Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or any Supplemental Order.
