NOTICE OF SALE 2019-CP-20-00348 BY VIRTUE of a decree heretofore granted in the case of: Vanderbilt Mortgage and Finance, Inc. against John Randall Powell, II a/k/a John Powell, II, Bridgette Danielle Powell and Midland Funding, LLC, I, the undersigned Special Referee for Fairfield County, will sell on January 6, 2020, at 11:00 a.m. at the Fairfield County Courthouse in Winnsboro, South Carolina, to the highest bidder, the following described property, to-wit: All that certain piece, parcel or lot of land with improvements thereon, if any, lying, being and situate in Fairfield County, State of South Carolina, containing one and .606/100 (1.606) acres, more or less, according to plat of survey for Minor A. Henderson, dated July 21, 2010 and recorded in Plat Slide 605 at Page 2007, Office of the Clerk of Court for Fairfield County, South Carolina and is by reference incorporated herein as part of this description. TMS No. 182-03-01-028-000 Property Address: 1359 West Peach Road, Winnsboro, SC 29180 TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Special Referee at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of noncompliance. Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee may resell the property on the same terms and conditions (at the risk of the said defaulting bidder).
