NOTICE OF SALE 2019-CP-20-00472 BY VIRTUE of a decree heretofore granted in the case of: Kondaur Capital Corporation, not in its individual capacity but solely in its capacity as Separate Trustee of Matawin Ventures Trust Series 2019-3 against The Personal Representative, if any, whose name is unknown, of the Estate of Iris Bowers aka Iris J. Bowers aka Iris Jeanne Bowers; Frank Panarello, Judy A. Panarello, Linda James, and any other Heirs-at-Law or Devisees of Iris Bowers aka Iris J. Bowers aka Iris Jeanne Bowers, Deceased, their heirs, Personal Representatives, Administrators, Successors and Assigns, and all other persons entitled to claim through them; all unknown persons with any right, title or interest in the real estate described herein; also any persons who may be in the military service of the United States of America, being a class designated as John Doe; and any unknown minors or persons under a disability being a class designated as Richard Roe and The South Carolina Department of Motor Vehicles, I, the undersigned Special Referee for Fairfield County, will sell on August 3, 2020, at 11:00 a.m. at the County Courthouse in Winnsboro, South Carolina, to the highest bidder, the following described property, to-wit: All that certain piece, parcel or lot of land with the improvements thereon, situate, lying and being in the County of Fairfield, State of South Carolina, the same being shown as Lot 1, 2.01 Acres on a plat prepared for Iris Jeanne Bowers by Russell Monroe Clowney dated January 14, 1998, recorded January 21, in Book 575 at Page 1548, Fairfield County records. Reference is made to said plat for a more complete and accurate description. Also includes a mobile/manufactured home, a 1992 Palm Harbor, VIN: VPNC7522AB  Being the same property conveyed to Iris Jeanne Bowers by deed of Jean M. McCuen, dated January 9, 1991 and recorded January 11, 1991 in Deed Book LI at Page 139; thereafter, Iris Bowers aka Iris Jeanne Bowers conveyed a one-half (1/2) undivided interest in the subject property to Johnnie M. Bowers by deed dated April 23, 1991 and recorded April 26, 1991 in Deed Book LL at Page 287; thereafter, Johnnie M. Bowers conveyed his one-half (1/2) interest in the subject property to Iris Jeanne Bowers by deed dated July 24, 1991 and recorded July 30, 1991 in Deed Book LP at Page 92; thereafter, Iris J. Bowers aka Iris Jeanne Bowers died intestate on May 5, 2017, leaving the subject property to her heirs at law or devisees, namely, Frank Panarello, Judy A. Panarello, and Linda James, as is more fully preserved in the Probate Records for Fairfield County, in Case No.: 2018-ES-20-00024. TMS No. 200-00-00-020-000 Property Address:  548 Landscape Road, Ridgeway, SC  29130   TERMS OF SALE:  The successful bidder, other than the plaintiff, will deposit with the Special Referee at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of noncompliance.  Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee may resell the property on the same terms and conditions (at the risk of the said defaulting bidder).  Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or any Supplemental Order.  The successful bidder will be required to pay for documentary stamps on the Deed and interest on the balance of the bid from the date of sale to the date of compliance with the bid at the rate of 3.0000%.  THIS SALE IS SUBJECT TO ASSESSMENTS, COUNTY TAXES, EXISTING EASEMENTS, EASEMENTS AND RESTRICTIONS OF RECORD, AND OTHER SENIOR ENCUMBRANCES.
